my boyfriend's mom is being sued for my accident!


What is the name of your state? Illinois.

In may, I fell down my boyfriend's stairs at his mom's house. I just missed a step accidently. After this accident I saw a chiropractor to fix my sprain in my lower back. Yesterday, my boyfriend's mom gets a letter saying that my insurance company is suing her for me falling!!! I want to refuse those charges. Can my insurance company sue his parents without my permission? Please answer soon!

Did the insurance company send someone over to the house to take a look at the stairs to see if the they were rounded, worn or dangerous in any manner?

Of course -- they have a right to try and get reimbursed for whatever they paid out to you, if there was negligence involved in your injury. It's no different than if you had gotten hit by a car -- your insurance company would pay for your medical care, but then would go after the driver for reimbursement.

If your boyfriend's mom has insurance, they will pay your insurance company if your boyfriend's mom is found at fault.

Yes, they're suing her homeowner's policy under liability.
