Is my post stupid or something?


What is the name of your state? NY
I posted a number of days ago about an incident involving my little girl. She just turned 2 and broke her arm after being shoved off a piece of playground equipment at Saratogo Raceway. I have since been able to contact risk management for the NYRA where I am to send her Dr. Bills. This would include all the bills arising from this right? Is this it? I learned from the lady at risk mangagement that the area is only for children 5 to 12 years old. There were children from 1 to probably 12 years old on this thing. There were also way too many and only myself and 2 other adults watching their children. I didn't see any signs posted with an age limit indicated. There also wasn't anyone their representing the track watching the area . So should I just let this go. I told the woman they needed to do something there so other children don't get hurt. My little one broke both bones in her right arm just below her elbow. They were clean breaks and I got to her right after she hit the ground. So I saw something not right for a split second and held her arm until it was splinted. So the bone ends didn't move and she healed well.
I would like someone to day something please. I am sorry that I am not a sue kind of person so I no nothing about this kind of thing. But I feel they need to do something at that play area. My daughter could have been hurt far worse if she had landed on her head rather than catching herself with her arm. Thanks ahead for any nice people that give me a heads up.

And what exactly about the installation or construction of this playground equipment was negligent?

Your child's injuries were caused by a) being pushed by another child and b) hitting the ground. So it appears not to be an issue with the maintenance or misuse of the equipment.
Did the playground have dropoffs that would be too high for little children?
How were those dropoffs hidden so that you as supervising parent would not be aware of them?
You say that the racetrack did not provide supervision for your children - were they supposed to? did they promise to?
You say that there were too many children on the playset at once. While supervising your child you were aware of this. What did you do about it?

Be happy that they will pay for you Dr. bills and push them to install a sign warning parents of small children.
