Need serious advice.


What is the name of your state? RI
My in-laws rented an apartment to us (they were living upstairs), the rental agreement was unusual in the fact that we agreed to split the bills. My husband has MS and we have 4 kids. They knew our financial situation from the beginning. We were getting along fine where we were (low rent, ample living space). We were financially comfortable, but finances still limited. We only found out a few months ago (after 2 years) that we've been snowed! We were paying more than 2/3 of the bills, and are more in debt than we've ever been! We've had to make repairs to the house (about $1000). We have things that we cannot repair, that were supposed to be done before we moved in, that cause a hazard to our children (live wires from old powerstripping in children's rooms). Our daughter's bedroom ceiling has been leaking since 10/05, apparently a faulty dryer vent upstairs. In the winter, the snow on the roof over our kitchen melts and leaks into our kitchen light. We have faulty wiring in the hall. No overhead lights in any bedroom. 1/2 the storm windows are missing. Not to mention unlawful entry. My FIL entered our home, while I was present, but without my consent, with a realtor and began showing him the place (no, we did not receive prior notice), he went so far as to walk into our bedroom, where I was without so much as a warning. 2 hours later MIL burst in screaming and swearing and refused to leave upon my request. Oh, and they have stopped oil service, even though I had been paying for it. What can we do? Do we have a case?

Well, I am not sure how much recourse you have for the wiring and such, as you did know about those needing repair and moved in anyway. But as to their entry without your permission, yes, that is illegal, they do have to give you notice of at least 24 hours in most states. Your best bet would be to contact an attorney in your area who is familiar with landlord/tenant law.

You should forget about the unlawful entry. Stick to recovering your monetary damages. You'll need to file a claim in small claims court against them to recover the money.
