Just a quick question – a neighbor’s tree fell (130 foot fur tree) into our yard -- it did no damage to any structures and took out two of our trees. 90% of the tree is in our yard. There was no negligence on our neighbor’s part – the tree looked healthy etc… Do we have a winnable small claims action against the neighbor – getting this tree out of the yard will cost 2k – our insurance and theirs will pay nothing no structures where damaged??What is the name of your state? |

| | | This issue was addressed in the Seattle P.I. last week. As stated, as there was no negligence, the neighbor cannot be held liable. And because there was no damage to any insured structure, your insurance won't pay. That leaves only one person liable for the cleanup. I had 2 trees fall into my back yard during the 1993 inaugeration day windstorm, I got lucky and had a couple guys take both trees and all the branches, all they really wanted was the firewood. Put an ad for free firewood on Craigslist, someone might do it for free.

| | | $2000? You already received your answer so I won't be redundant but I have to say WOW at the cost of removal. I just had a 150ft tree cut down and removed for $200 by a licensed company. |

| | Post an ad in your local paper for free firewood. As racer said, Douglas Fir makes decent firewood and you can probably find somebody that'll take it off your hands. There's a lot more demand for firewood these days with oil, gas, and electric prices where they are. Quote:
