No lifeguard on duty in Hotels' swimming pools


Could anyone advise whether when a hotel states that there is no lifeguard on duty then the owner is not liable for swimming accidents? In a potential court case what would the court's decision be in case of just an injury or even death?


sorry as I am new in the forum. I am talking about Hotels in Cyprus as most of them state that they have no lifeguard on duty, whereas according to HSG179 of the Health & Safety in the UK a pool should have according lifeguards as to the size and depth of the pool. I know that due to the fact that Cyprus is part of the European union now, there are different view on the above. As far as the cyprus law is concerned what it is mentioned is pool safety attendants trained in first aid and water rescue but does not mention the word lifeguards.

Sorry, this site is for US law only. We have no idea about the law in any other country.
