OREGON - child abuse case in child development Center by teacher

Our 3 yr old daughter was physically abused at the local community college child care center on 2 occasions by one teacher. (she's 4 now). This was back in August of 07.

She is mild special needs - mild autism spectrum...

The teacher who was apparently not trained in dealing with special needs kids decided that it was OK to hold our daughter down on the nap mat. (she was the only teacher in the room at the time, no witnesses but our daughter) Of course, our daughter does not like to be held down (who does?) so she fought back and this woman put bruises all over our daughter's legs (fingerprint bruises and hand-prints). Our daughter came home and told us that this teacher held her down on the nap mat and that the teacher really hurt her back and legs. We found one bruise on her back, most of the bruises were on her legs though and in her brain because 5 months later she is still really anxious and scared. We took photos of the bruises, called a meeting with the director of the center, and others, and we were treated like we were imagining things or that our daughter made it up or something. It was the strangest thing. So, we (after 3 great years) tore our daughter from that school and have not had child care since then because we cannot find anyone we trust. But, it does not end there. A few months later we found out that this woman was still teaching, but younger kids now. So, we called the sheriff's office, the human services department, etc...(what we should have done RIGHT AWAY but we THOUGHT that the school had to report it or do something about it!- we were VERY Naive!)

Our girl was interviewed by a detective and a child psychologist on video and she told them what happened to her and pointed it out in the photos.

We are pressing charges but the detective has not been allowed to finish the case.
The school has pulled some trick in not letting the teacher(s) (there was a 2nd case similar but not the same teacher) be interviewed by the sheriff. The DA's office told us today.... "The detective was not able to obtain interviews from the suspects because of privacy acts in place by the Federal Educational Records Privacy Act." So, now they are allowing "RESTRICTED interviews of the suspects" which is amazing to us and that will be completed next week.

So it has came up WHY WOULD they want to hold off so long like this? IS there a statute of limitations in Oregon for something like this? Is this a personal injury case or ?

So, the school sent us a letter saying that their "internal investigation" showed that there was no harm done or something like that. yah whatever!!!!!!!!!!! It was like adding insult to injury!

At any rate, we are at the point where we think we want to sue IF we have a case. We feel that the woman who did this has caused our daughter unbelievable harm. We had no idea that our daughter would still be so scared about all of this. She just said yesterday, "Is ***** going to come to our house and get me? I am afraid that she is going to come here and get me!"
(we are trying to find a counselor here who takes patients as young as 4- it is not very easy actually--- our daughter has even been given funds from the victims assistance fund)
So, sorry that this is so long and i hope we posted it in the right place(s).
