Pain and Suffering


What is the name of your state? South Dakota
I tripped over large rock in parking lot. This rock is normally in busness landscaping but was kicked onto driveway by somene taking shortcut to vehicle. I received major body damage which may affect the rest of my life.

Do I have recourse here?

Agree with ecmst. And you can tell by the number of my posts, I do not do this full time.

You possibly have a case against the driver who caused the rock to roll into the parking lot.

I'm curious to know what the "major body damage" is... Not that it makes any difference because it's still their own fault. It's just that I can only picture someone twisting their ankle or bruising themself when they fall, and that's not major.

Sue yourself. You placed your foot on top of large rock and fell. There could be some potential liability on gravity as well.

Might be careful to keep it quiet though. The owner of the driveway might sue you for damages caused by your thick head hitting the ground.
