Personal Injury claim for minor accident


What is the name of your state? Texas

Hello Sir,

I am from India and living in US for last 2 years.Recently at a signal stop i hit back car by wrong use of gear under tension when back person blow honk.This is very minor accident and no damage to either of the involved parties cars.Since this is minor accident and no damage was seen no we didnt call cop when this accident happened.But later on other person started claiming personal injuries and damage to the car by calling the cop and take my details.My insurance adjuged the damage for other party car and paid some 1000 bucks towards damage and i didnt claim any amount since no scarath or dent occurred to my car.Now other party is trying to exploit money by stating personal injuries.It seems my insurance didnt settle any amount towards injuries since other party failed to provide requested records from doctor.Now other party approached attorney and sent notice to claim personal injuries.

After seeing the notice , i talked to my insurance and they told me that they are following up the case and there are chances that it might go for file case and sue me.

I really tensed and never involved in any accident so far and do not any rules and process.I am really wondering with minor accident at signal stop on feeder road itself has become this much big issue and attempting to claim personal injuries when nothing happened.

Could you pls advise me what to do in this case.
If my insurance dont do any thing and when other party file a case what should i do?.
Is my insurance suppose to handle in that situation?
Do i need to seek attorney or my insurance should do that?


Pls answer my questions..

There must have been some damage for your insurance company to have paid out 1000.00.

I was recently rear ended by someone. I was sitting at a red light and she came plowing in to the back of me at approximately 35 mph. She caused approximately 1000.00 in damage to my car. Sitting still at the light, being rear ended, can cause injuries.

How do you know they don't have injuries?

You caused an accident, have admitted liability (I am assuming since your insurance co. has paid out for property damage), so now you need to let everything follow its course.

Thank you for your response.

we knew that no one got injured.In my car 3 year old kid was there and more than that when a car go at a speed of 5 miles/hour what could be the impact? but in this case other party's intention is to exploit money only anyhow we are helpless.


Could Pls answer below questions.

If my insurance doesnt pay towards personal injuries for other party by any reason then when other party file a case (sue) what should i do?.
Is my insurance suppose to handle in that situation?
Do i need to seek attorney or my insurance should do that?

You only hit them going 5 mph and the person you hit had 1000.00 in damage to their car??????

If you are sued by the person you hit, your insurance co. should handle that, including providing counsel to you Talk to your adjuster about that.

Just because no one in your vehicle had injuries, doesn't mean the person in front of you that you hit didn't. Realize, when you hit someone, their head is usually thrown forward and then back, which can cause an injury to the neck....it's called whiplash. If their head hit the steering wheel, it can cause other problems.

What type of car did you hit? Reason I ask is because if you caused 1000.00 in damage, it was either a very expensive vehicle you hit, or you were going much faster than 5mph!

My car is toyota corolla and other party's car was honda crv.

My car had 2 tiny dots for that my insurer calculated the damage and wanted to pay 350 bucks but i rejected to take the money from insurance company.May be some companies are quite liberal to pay more for the damage.

As per your info, my insurance company should handle this case without my presense.If in case they dont do this, should i be able to file case on my insurance company?

Your insurance co. will need your assistance at some point, but they will handle it...i.e. if you are sued, they will provide counsel for you..they will handle the property damage claim, etc.

If they paid the owner of the CR-V 1000.00, then that is how much damage they had. Insurance Cos. are not in the business to pay out anymore than they have to.
