Pregnant slip and fallWhat is the name of your state? Florida I am 8.5 months pregnant, and slipped on a spilled drink outside of a restaurants bathroom. There was no sign warning me nor was there someone there to warn me of the spill. Though I did not suffer any serious damage (to my knowledge) I have this fear that won't go away that the fall some how hurt my baby. I did not fall onto my stomach but it did strain for a minute, and the stress of the fall. Is there anything any thing I could file against this? If so , what would it be called? It's like I am living this nightmare now, that I could have fallen onto my stomach because of their neglegance and lost my baby!!!! |

| 1. You can't sue for an injury that could have happened. 2. You would have to prove that the restaurant both knew the spill was there and was negligent in cleaning it up in a timely manner. |

I am now feeling the pain of the fallI slipped and fell due to the carelessness of a restaurant. I am 8.5 months pregnant, I slipped friday night and it is now monday. I can hardly stand due to lower back pain. I am waiting for my O.B to get back to me on what I should do, because I know being pregnant I can not have x-rays or any meds. I have consulted a lawyer and will meet with him this week, in case something is wrong. What would I need as evidence to the fall? What if the restaurant denies all allegations? I was out to eat with a friend who can serve as witness. Would this be enough? I know the restaurant more than likely did not file an incident report. |

| You MAY be able to have x-rays at this late stage of pregnancy, depending on what part of the body and how great the need is. But if you are just stiff/sore, your doctor will probably just advice RICE for now and see if you get better on your own. It is much more important for you to deal with your doctor right now, rather then worrying about getting a lawyer involved, when you don't even know if you have any serious injuries. Running right to a lawyer makes it look like you are looking for a big payday, rather then genuinely being concerned about your injuries. Last edited by ecmst12; 03-31-2008 at 03:30 PM. |

| At 8.5 months pregnant there are negligible risks to the fetus from medically necessary diagnostic X-rays. The abdominal muscles, thickened uterus, and amniotic sack provide all the protection a healthy mother and child require from ordinary trauma, including frontal falls, even falls from height. This is less true for higher risk pregnancies of course, by why would a high risk pregnant woman be a restaurant less than 14 days from term?

| you need to have informed the restuarant at the time it happened or you will have to prove that you were there and that what you say happened happened and that is what caused your injuries. im sure the liquid has since been cleaned up, how can you even prove it was there now? how can you prove you didnt injur yourself over the weekend? as for proving your case against hte restaurant, in addition to having to have filled out an accident report there at the time of the incident you need to be able to prove 1) the restaurant knew or should have known the liquid was there and 2) was negligent in their cleaning of it or their time to clean it. |
