Release and IndemnificationAgreement


What is the name of your state?Florida Injured by emplyee of store- hit by shopping cart. I was a customer what does this mean in regular words: we agree not to hold harmless and indemnify The Store,if we have recieved payments under insurance is entitled to reimbursement or has subrogation or lien rights then we agree to hold harmless, The Store. It is underestood and agreed that this indemnification agreement specifically includes all costs and expenses of the parties for further claims arising out of this claim.Does this mean the store will pay the health insurance co. back what hey paid on the medical benefits? Or do I have to pay them out of the small amount I got???? Please Help.

Do you really expect someone to be able to answer this post? What on Earth are you talking about? Is that supposed to be English?

I think that the OP is asking for a translation of something they got from the store (or the attorney representing the store).

OP....please explain what happened after you were hurt ie...did you go to the doctor ...did you file a claim with your insurance ...did you submit bills to the store....have you hire an attorney or has the attorney for the store contacted you?????
Please keep in mind that we know nothing of this situation and you need to be clear in your post.

Correct Baystategirl, I was hurt at the store, I went to the doctor Pysical therepy ect. These vists were filed to my Insurance Co. Insurance co. paid and I paid my part. I sent copies of my EOB's to store claims dept. No, I did not hire a lawyer. After a year now the stores claims management offered to settle over the phone, I agreed. I recieved the R&I Agreement. The wording I do not understand. I was told over the phone that other than the settlement offered they would pay back my insurance co as Insurance co. could put a lien on the store. In the legal writing has thrown me off as whether the store will pay insurance co. back or by signing am I releasing the store of that and making myself liable. This statement says: It is underestood and agreed that this indemnification agreement specifically includes all costs and expenses of the parties for further claims arising out of this claim.Does this mean the store will pay the health insurance co. back what hey paid on the medical benefits? Or do I have to pay them out of the small amount I got???? You can read more of what was written in agreement in my original question. Thanks. I think that it means that this is all you get and you can't come back if you discover more injuries related to this accident...I also think that the amount you received includes the amount to pay back your insurance...but I'm not sure.....have you signed anything? Has your insurance company said they were going to seek reimbursement?
