Proof is not required. The issue that a court would have is solely the issue of whether the merchant or property owner was negligent in NOT taking 'reasonable' efforts to mitigate the risks to the customer/tenant.

The real issue would be, what is considered reasonable precautions to secure a parking lot? Adequate lighting? Camera surveilance? Actual humans patrolling? I kind of doubt that the minimum reasonable precaution would require human security patrols.
