Robbed in Store-Virginia


I live in Virginia. My question is simple. I was in a large chain store yesterday and 2 young ladies came up to me. One was asking directions (distracting me) while the other took my purse out of the basket. They then both ran from the store. I immediately started screaming and as a result the police were called and they took an incident report. They asked the store to see their surveilance tape and the store said that their tapes were not working. These girls stole my purse with everything in it, including $250 in cash, all my credit cards (which I have now canceled) and my cell phone (which I have also canceled).
My question is this: Does the store have any liability here? I am not looking for anything except the return of my $250 cash. If the store is liable, I am hoping to just go to them and threaten them with a law suit. And tell them it would save both of us a legal fee if they would simply reimburse my $250. If the store is liable, I'm sure a lawyer would go into pain and suffering and punitive damages, etc. All I want is my money back at this point. I just need to know if the store is liable. The store is ROSS and they are a huge chain here in Virginia and all over the USA. Thank you so much for any helpful legal advice that you can give me. MAXIMA

I thought perhaps the store would be liable because they didn't provide adequate protection to it's patrons. Am I wrong?

Who made you the final authority? Is there anyone else out there that agrees with you? I'm looking for some CONFIRMATION that I have no chance to get my money back from the store. Why is a store liable if I fall down and break my hip in their store? What is the difference? They failed to make me SAFE in their store. Thanks for any comments.

My response:

I agree with Happy Trails. The store does not have a legal duty to protect you. They also have no liability for the acts of third party criminals - - unless you can prove that this is a constant problem. Then, the store MAY have a duty to hire a guard. But, you never stated whether this was anything other than a unique situation for the store.

So, there you have it - - CONFIRMATION.

Did ROSS force you to keep your purse (with $250 in cash) in your cart instead of on your person? Girl - you've got liability your own self.

While it is truly unfortunate that you were victimized, you have not walked away from this without learning something.

Right now you are upset and angry (understandable). Educate others as to what has happened to you, you will get some satisfaction from that.

I was robbed 24 years ago (different situation and it was violent). You really never forget about it, but you do become wiser. I'm very aware of my surroundings and cautious if anyone does approach me.

Thanks, Happy Trails...I know every word you say is true. I am lucky that they didn't slit my throat or break my arm. I thought I was cautious also, but now I know better than to trust just anyone. The girls that robbed me were very young (maybe 18) and very well dressed...I will certainly keep my guard up better and will tell anyone who will listen to do the same thing. I'm sorry that this happend to you. If possible try not to carry large sums of money(keep maybe $20 for emergencies) on you anymore. If you have a debit card I would simple use that for large purchases...at least you'll have some sort of recourse when something like that occurs.

Karma will catch up with those heathens sooner or later.....
