schoolyard injury


New York City

My 10 year old, was injured in the schoolyard of his school during recess. He fell and broke both his two front teeth, they are destroyed now. Is the school liable?

My response:

Much like the Internet allows their parents to "run around" asking stupid question like yours, without any supporting evidence of negligence. It's an absolute crime!

HELLO these are children and ADULTS in the school are not suppose to allow these children to run around like nuts, even if it is my kid being the nut, hello make him sit down, or call a time out or do something just dont ALLOW them to hurt themselves!!!

Then, using your logic, you can have a separate and distinct Children's Services case opened on you each and everytime your child hurts themselves in your care, or gets a sniffle, a disease or is otherwise endangered.

After all, you are ALLOWING it to happen.

Why even have recess if you are going to force the kids to act like they would inside the classroom?

Running around is not in and of itself dangerous. Now if they were letting the kids have jummping contests off the schoolhouse roof and the kid got hurt then you'd have a case. But running? Are you serious?

My response:

The writer just doesn't get it. She thinks if her child gets hurt, that someone else is responsible. Without negligence, there is no "fault." Kids fall and hurt themselves all the time.

I think what our writer is trying to do is "shift" the medical bill to someone else because there is no insurance.

Question: so then there shouldnt be any supervision in schoolyards? If my child is doing something that will make him hurt himself then stop him!!!

Look... tell your child to keep a look out for his shadow so that he doesn't trip over it again.

And, tell me - - how do you stop a child from running at recess?

umm not at all we have insurance, but its not the point! I had to leave my job to go to the school to find my son sitting there with a big swollen lip, all this blood and his destroyed teeth!!! u damn right someone should pay!!! I know kids are kids but u just dont let them do what they want! thats the whole point in having supervision!
