It could be both are liable to you. However, that depends on a few things, like how much was the separation, and what do your Municipal Codes say about homeowner responsibility for the maintenance of the sidewalk?
See a personal injury attorney. At the very least, you'll need to serve a "Tort Claim" against the city, and you don't have much time to do that.
