slip and fall


What is the name of your state? North Carolina
What should I do, if anything? I went into a local grocery store. It had been raining outside. I went to the checkout counter and was in between candy shelves and there was an extemly large amount of water that I did not see until I had fallen. The girls at the counters saw me. I fell on my left knee and my right foot went under the wire candy counter and my 2nd and 3rd toe got caught under it. I pulled it out and thought I was ok. I walked about 5 feet and my foot started really hurting. It was already swelling so I went back to the front end manager. She called the manager. He took the report and said they had video cameras and would check it. He said he could not advise me to go to the emergency room. I went home and my foot was in pain. My husband took me to the emergency room and found out my toe was broken in two places. I was sent to an orthopedic doctor. I was out of work 11 weeks from 2 jobs because of being on my feet and having to wear safety shoes on one job. It has now been 12 weeks, the doctor said that surgery would not help, it would have more complications. I have permanant damage to my toe. It is swollen, crooked and pertrudes abover the others. The doctor said I lost all movement in the 2nd and 3rd toe because all the ligaments were torn on both toes. I cannot wear a shoe more than an hour it hurts. Arthritis is setting up and he has me on pain meds and arthrisis meds. I have not contacted a lawyer, all the bills have been filed on my insurance. I took all my sick leave and vacation leave. I am waiting for their insurance company to send me a settlement from them. They said they could pay no bills until the Doctor released me. He has told me to come only if I need but all they could do was to scrape the bone and put a piin in my toe but it would still not be able to move and only help a small amount. Thanks for any advice!

Do I have any legal recourse for this accident and what are NC laws about slip and falls?

That depends on the totality of the facts surrounding the incident and no one is going to litigate this for you over the internet.

In other words, consult with a LOCAL attorney.

I was hoping to find out if it was even worth consulting an attorney. It was their fault, I am hurt and have perm damage to the foot, but I was just wondering about NC laws concerning slips and falls and if it were even worth looking into..

Ask for a free consult with a local personal injury lawsuit to see if the slipping and tripping will get you some dough.

I'm really curious how the OP determined that the store is at fault for
1) Rain falling from the sky and
2) The customers wearing cloting that would collect water so it would then fall off of them at the registers while they were paying for items.
