Slip and Fall


What is the name of your state? Texas
I slipped and fell in some water on the floor in a drug store i developed a contusion just below my knee cap. They have already sent me to Care Now, nothing is broke or cracked--i still have a sore, bruised knot on my knee. should i get an attorney or is it normal practice for them to make me an offer to settle the case. A rep called me on Monday and said they will wait until i go to the doctor for the second visit before they would settle the case.

If all you have is a bruise that will heal completely in a week or 2, you're not really entitled to more then your medical bills. If they offer you more then that, consider yourself lucky.

Below is my original post. My knee is almost completely heeled now. The insurance company has sent me a check for my medical bills. Do they owe me for damages or anything??

What damages? Your only "damages" are your medical bills (which they paid)

Thank you for your reply Zigner. What was undiscerning to me was when I told the cashier what had happened (btw I fell near the register she worked) she looked at me and did not respond in any way. I had to go find another assoc. to get the manager, which by then she attempted to clean up the water, I say this because when I showed the manager the area I fell in there was still a substantial amount of water on the floor and she had the paper roll and a wet paper towel laying on her register where she had went back to by the time the manager came out. This is what distressed me more than slipping in the water (could have been something other than water) I don't know.

in other words, it doesn't matter if you tell someone you just slipped and fell and they choose to do nothing about it until you seek the manager's assistance?

I guess I am lucky they offered $250 for the inconvenience I am singing the release now. All i wanted them to do is recognize their fault re: actions of the clerk and the inconvenience of my injury.

Yes it is much better! I am thinkful i don't have any apparent damages...i am 49 years old let's face at this age it takes longer for things to heal. thanks for your concern!
