Slip & Fall in Retail Store on Broken Floor


Tennessee-I had a slip and fall back on 07/22/07 at a retail store. (their floor was badly cracked and still is almost a year later) I did receive a head injury and after a 3 1/2 month headache and 4 months of physical therapy I am now functioning fine. I only have problems with travel, the prolonged jarring causing the heachaches to return but I can use my exercises and tens unit and get rid of them within several days. I will have to continue to be monitored every 6 months by my neurologists but have ben released from his daily care. The store's attorney (It's one of those companies-Gallagher and Associated, has been in contact but over the past month and a half they have not returned any calls. I have submitted all costs associated with the claim and they have received all my medical bills. 2 questions...how long should I wait for medical reimbursment? ( Accident on 07/22/07 and released form doctor on 11/23/07. ) In TN am I eligible for any pain and suffering and/or future medical as I will see the neurlogists every six months for life.

This seems a long time and you should follow up on it. The company usually won't pay you without a specific demand. Have you made one yet? I think you should get something for pain and suffering and certainly should get something for long-term costs associated with the fall. (If they are liable. Which, on the surface, seems they are.) If the numbers are getting large, you might want to see an attorney.
