Slip on a ship


What is the name of your state? Ohio


In mid-August of 2005 my wife and I were on a 7 day cruise. On the fourth day we were walking on the top (exposed) deck of the ship when she slipped on a puddle of water on the deck. The puddle was aparently, caused by a rain shower that had occurred approximately 1/2 hour previously. There were no wet floor signs or other warnings around the hazard. As soon as she slipped and fell, a wet floor pylon appeard right next to her. Cruiseline personnel (mainly, coctail waitresses and other service people summoned the medical team and a nurse was there in minutes. After being seen by the ship's doctor, my wife spent the rest of the trip in a wheel chair and in pain. The trip home was a nightmare as she could not walk through the airport and could hardly get her leg in a position that would allow her to sit in the airplane seat without great pain. When we got home, she went to an orthopedist and he said she had a torn ligament and that the accident has hastened her need to have a knee replacement (she has arthritis, a joint illness, not related to the ligaments.). The curise line did not investigate the accident except for a phoine interview the next day after the accident.

Our first instinct was not to seek damages, It looks like this injury will affect our lives for the forseeable future.

Does the cruise line have liability here? Or is it just "an act of God" that it rained?
