Subrogation from health insurance carrier?


What is the name of your state? ARIZONA

Hello, I have been notified that my health insurance carrier hired a subrogation agency to recover thousands of dollars of medical expenses paid on my behalf after a slip and fall accident that is now subject to an "out of court" settlement.

Am I personally liable to reimburse my insurance company out of my settlement? Or can they only go after the responsible third party for recovery of their funds? I have been given conflicting information from my lawyer and another lawyer I consulted for a second opinion.

Your help is greatly appreciated.

My understanding is if your medical (health) ins. carrier paid your medical bills due to your accident, they are entitled to reimbursement out of any settlement you receive. Otherwise, it's sort of like you are getting paid twice. The cost of the medical bills was probably included in your settlement.

Yes, you are responsible for reimbursing your health insurance for the cost of your accident-related treatment out of your settlement. Make sure you and your lawyer take this into account when determining the settlement amount.
