uninsured homeowner


What is the name of your state? CA (Los Angeles)

I forgot the lock the back gate after the gardener was here and let my dogs out. One of them ran out of the yard, crossed the street and jumped up on someone, knocking him over. He broke his arm badly and required surgury. Animal Control came over and ruled my dogs are not people aggressive, just exuberant. I know this is my fault. I didn't have home owners liablility. His attorney has contacted my insurance company and they say I have no coverage for this and sent me statement to that effect.

They (the man and his attorney) presented me with some medical reports, but no bills. He has HMO coverage, but evidently they are not covering everything. They say that his doctor bills are about 40k. The accident was late June and he is still wearing a brace. He wants something for pain and suffering. They expect me to make an offer. I have no idea what a fair offer would be. If he is not utilizing the HMO doctors am I liable for the extra expense that this causes?

All of the lawyers I see are for personal injury plaintiffs. Where can I go for consulation on this? How can I find out what typical settlements are?
