4 Names on deed who has rights to what


What is the name of your state?WV
When my parents divorced they had re deeded the land so that as we came of age (18) each of our names were added to the deed of 114 acres of farmland. They in turn do not have their names on the deed anymore. There is no house on the property and right now no one is living on it either. I am the oldest and the youngest just turned 19. With four names on a deed what does that mean necessarily? Do we all four have to agree on every decision made in regards to the property or can one person do something without asking the others? Just curious as the oldest I like to be informed. Thanks in advance, Lori

All four have equal rights and no, you do not have to agree on anything. If ONE of you wants to divide or sell the land, then that one can file a partition suit and let the court decide.

K, thanks very much, that is what I thought, Mom says the lawyer she spoke with when she changed the deed, begged her not to do it this way because of such a problem it could create. lol And what are the chances of four people ever agreeing on anything! Is there any way to legally require that all four agree on something before it is done to the property? Or am I just wishful thinking?

it's family. Where family is concerned it's a pipe dream and the pipe isn't filled with anything legal.

If you want to do something with the land, then partition it. THEN, those who want to join can and the holdout can go his or her merry way.

One more question, my middle sister recently got married? What does that mean in regards to property rights as well?

Ahhhh....siblings can't love em...can't kill em for fear of going to jail! JK (I really do love them and what to sort this out so that everyone can be as happy as possible!)

It simply means that if she dies he gets it or that at a minimum, things are more complicated for her.

Tell her to stay married.

You have been so helpful, thank you, I just want to make sure I think of everything and we get to talking about it as a family long before there are any problems. We are all young and very new to this.
