Driveway Agreement Pennsylvania.
When I moved in my house 4 years ago, my neighbor told me that our houses were previously owned by two brothers. My house has a driveway next to it and my neighbor's house doesn't. Apparetly, the brothers decided to sign an agreement allowing both property owners to use the driveway so long as the regular maintenance was kept up by both. My neighbor sold the house on a land contract to my new neighbor one year ago. Up until my old neighbor sold the house, we had no problems. He only used it if he needed to load something into his truck or similar circumstances. (It should be said that the driveway is approximately 12 feet wide and approximately 10 feet of this is on MY property.) When my ex-neighbor sold his house my new neighbor began to use the driveway on a daily basis. I have seen the original court agreement that was signed over 20 years ago. My question is,.....is there a way to have this original agreement done away with since the original property owners (the ones who made this agreement) are no longer inhabiting the houses, or does this agreement become part of the houses' real estate?
