| I am part of an organization that is building hiking trails. We have a historical use trail that has been disrupted with several land developments. I am trying to find out if using the adverse possession or prescriptive easement rights would be a way to acguire a trail easement through some of this private property? I live in Washington State, Benton County. |

| This issue can get very complicated real fast and there are various issues such as if your hiking group is considered private or public, how long have the trails been used and has the use been constant (not abandoned for any long period of time), has the trail been designated a historic trail or can it be, will the government back the trail preservation or the development/developers (politics) etc. I suggest the group hire its own attorney to look ito these matters. |
