Advice Please - Home Owners Association


What is the name of your state? California

I live in a single family residence with a home owners associatin.
Recently i have received several letters, stating that i have to park "one primary vehicle" in my garage, if not i will get a fine. I own several vehicles, one is a truck which does not fit in the garage, the other a car which i park in front of the house. My garage is clean and organized. Most of the surrounding neighbors have junk and or furniture and other things in the garage, no cars. Also the CCR's state that you cannot have any recreational vehicles or motorcycles in the garage which people do have.

Another thing is that my garage is never open, in the last month i opened twice and both times it was at night, how do they know that i don't have a vehicle in there.

My hearing with the HOA is Monday, I need to know if i have an argument or maybe a loophole to argue my case. This association is very picky and unfair, in the past i have gotten a letter for leaving my trash can outside 1 extra day after the pick up.

**A: simple solution, park your car in the garage and the truck outside.

Yeah, No S**t, I'm just trying to see if i have an argument with the HOA, they have been pain for 3 years.

How is the CC&R worded? Does it say that you can only park one vehicle outside of the garage? Does it say you have to choose one vehicle that will stay in the garage?

Without seeing the details of your CC&R, we really can't say if you have any valid argument.

The original CCR does not state anything about a vehicle in the garage, last year they amended that to:

"Owner must use the garage for one primary daily vehicle"

So how do they determine which car is a primary daily vehicle?

I am willing to park my car in the garage, but I feel that i'm being singled out because im on a corner lot and next to my property there is plenty of space that i use and other neighbors use. Also if my garage is rarely open, how do they know what i park in there, for all they know i could have another car in there.

When i get home i will dig up the CCR's and post the legal terms they used.
