Am I shafted?


What is the name of your state?What is the name of your state? WV

Please help! I signed a land contract with my now ex-boyfriend a few years ago. I had to remove myself from the situation, so I left last June (He said that I would have to have him removed from the house by the power of the court anyway!)

I offered to continue my end of the contract, but he refused to allow me to continue with my share of the house payments. At first he agreed to reimburse my investment to me, but then turned very hostile.

I just found time to file my complaint in magistrate court. His answer is total denial, and he is counterclaiming $2500?!? I called the previous owners of said property, they told me that they gave him the option of moving out or completing the purchase in October after 5 mos. of nonpayment (when they mentioned that I may financially help, he became very defensive).

It so happens that the contract expired in September, he took out a loan and finalized the purchase in his name in Dec.! He now owns this property with $4000.00+ of my money that he will not return- it is so unfair.

The twist is that this property is going to be bought out from him to make way for a shopping plaza at a "buy out" price. I don't care about all of that, I just want my money back.

I have all records of payments made, I am so stressed, do I have a chance in court? Thanks.

A: It sounds like you waited too long to do anything. But, your story is so confusing that I am not sure what happened here.


Could you post the contract exactly as written (without personal info)?

Also, reword your story including all the facts and leaving out the editorial comments. We already know you are the good person and he is the bad person.

Could you post the contract exactly as written (without personal info)?

**A: if the contract expired, he may have talked to the Seller and the Seller negotiated directly with him and he bought the property in his name.
