I am currently seeking new office space for my company. I found an office advertised in the local paper as a sub-lease being represented by a major commercial real estate agent in the area. I schedule an appt to view the space and decided to take it on the spot. I told the agent i wanted it and asked what we needed to do (contact, financials, etc.). He stated someone else had an offer on the space. I asked him how much $ they had put down and he said none, I then asked what they were offering and he said slightly less than the published retail price. I told him that I was offering to pay full retail, and asked what the problem was. He told me he would fax me a proposal when he got back to the office. He didn't so i faxed him a signed letter stating I was accepting their published retail price.

The agent contacted me today and said they were rejecting my offer even though I was offering more $$, but that they would offer me a larger space they had avialable.

I was under the impression that if you publish/list a space and someone offers your asking price, you were obligated to sell/lease it.

Can they legally refuse to lease the property to me?
