bought property discovered septic next door


ny-I bought property and discovered my septic on property next door. Old neighbor/owner accepted condition, new owner found tank and destroyed it. what is my recourse?
any help is appreciated.

no, there's nothing in writing. this setup has been this way for 26 years. does this mean anything? thanks for your input.

If he destroyed the system, what is your current waste disposal system?
There is more to this story than what you have posted.

we found another septic


1st, thanks and yes i should fill you in.
the property is a bar/rest. and apts. we were able to find another tank and my dad ran the pipes to it. while most would think no harm then, that's really not so much the point. the whole property (including neighbors) use to be one big parcel. when we bought it the owner wanted to stay in the house furtherest from the bar and divided parcel. he died, next owner knew of septic and didn't object (12 yrs.) then there's this owner who filled it in. building inspector in town gave us notice because when neighbor did some excavating he uncovered the line. building inspect. said to remedy, fill in and build new septic. how could this inspect. order us to go on someone else's land and fill in? Wouldn't you think the set up should have been grandfathered somehow? I don't know if this new owner was told of set up by previous owner. We had no contact with him until after he purchased property. This use to be a resort area, which is now turning into a bedroom community. Thanks for your interest, your input is greatly appreciated.

The building inspector was correct.
You need to hire an attorney due to the complex matters.
