boundary disputes

My mother purchased a land parcel and house.
We bought the property from her a year later.
When we had a survey done it was found that a neighbor's fence was about two feet on our side of the property line. If the neighbor refuses to remove the fence can I just take it down myself or do I have to instigate legal action first to reclaim our property?

Have you spoken to your neighbor about your findings? You cannot remove their fence without replacing it. Both parties need to contact their title companies to determine where the true boundary is. Another survey may be necessary. If there is a error in the property lines, title insurance may cover the loss.
