more from,
the landlord who won't go away!!!!!

Ok, I really want to move but the lease won't be up until March 15, 2001. If I were to dig up some of the crap I've found, would I be able to break the lease? I'd also like to get my $600 security deposit back...

I have the WORST luck with landlords!

Thank you so much for your help!

You have to prove just cause in cancelling your lease. And if you do it legally, you are entitled to get your deposit back. Do some research with the City/County/State to see if there was in fact an approved legal dump there in the past. And what type of dump ie. standard landfill, industrial, environmental hazards etc. If so were there approvals and inspections completed to prior to the dump being covered with soil? You already have a claim since L did not disclose to you prior to you signing the lease that the property was a dump. Contact the State Health Dept and tell them the items that you are finding on the property and have then conduct inspections and maybe do some soil and air quality testing.
The stuff buried in the soil could be usual garbage but I am concerned if you are finding medical vials. There could be medical bio-hazards, syringes, and other harmful things such as asbestos, lead paint, oil, pesticides, industrial waste, Firestone tires etc. The property very well may have been an illegal private dump.
