New York State / Apt Rent
I left a 1-month deposit with my broker last week (security amount - certified check) and my credit check has been approved.
I have not signed the lease yet because the landlord is waiting for the certificate of occupancy (CFO).
The broker wants me to pay the broker's fee now. Should I pay before having signed the lease or seen the landlord?

Isn't it refundable if the certificate of occupancy does not come thru?
