Builder not returning earnest money

State of Georgia. We had a contract to purchase a home that was being built . We had some extras put in house and added to sales price, builder agreed to do. Found out towards the end that our truck wouldn't fit in garage and wanted to back out. We had the purchase of the new home contingent upon the sale of our current home so we left our house on the market and did not get an offer and were unable to sell. The contract to purchase the new home has expired and the builder will not refund our earnest money and has also obtained a contract with a new buyer. We have followed the stipulations of our contract, does the builder have the right to keep our money?
