Michigan. i have a binding sales agreement on a piece of commercial property and the closing date is a few days away.
i am the seller, the problem is both myself and the buyer feel the realtor (i hired) has told many lies to each of us to achieve his goal of making the sale, gave each of us conflicting info - none of which was to either the buyers or the sellers benefit - his only interest was in getting his commission. my question is this; is it advisable for both the buyer and seller to consult with the same attorney to bring some type of violation of fiduciary responsibilties charges against this creep? both myself and the buyer are actually so upset that we have given each other the opportunity to back out of the deal - i feel this realtor should be accountable. Any reply? Thank You.

Once the deal closes then one attorney can represent both parties as Plaintiff clients. Until then, it would be a conflict of interest for an attorney to represent both Buyer and Seller.
