Can HOA raise fees without owners' consent?


What is the name of your state? Florida

Can HOA raise fees without owners' consent?

Can undisclosed members on the HOA Board of Directors increase association fees without notification or consent of condo owners? There are numerous damages and safety risk conditions on property which are not being addressed, along with extended damages by "critters" in condo ceilings as a result of these unaddressed damages by the HOA. There have numerous phone calls, emails and letters made to the president of the Association, pleading for some answers to the issues mentioned, but not one of them have been responded to. In fact, we keep getting invoices sent with the new amount of the increased association fee. We have no information as to how many people were present to vote in the new amount (which has been increased twice in 2 months), no minutes of the meeting have been provided as asked, no financial report has been provided as asked. Our question is, do we have to pay the increased association fee and can we deduct from the association fee what money is spent to repair damages of our condos, which are the association's responsibilities? Please advise. The damages issues has been ongoing for more than 2 years and the association fee issue started in January 2006. HELP!
