Can judgment lien attach to homestead property?

I have seperate property granted as homestead in 1994. I married and my husband had a judgment against him, individually in 1997. Our home is now under contract for sale with closing to be July 30, 2005. Last week, we were informed by the title company that the property has a lien that must be settled before they will insure title. I contacted the attorney of record in the judgment proceeding and asked for a partial release of judgment lien and informed it was needed before closing. He said he would look into it and call back. I called to check again, no reply.

If he refuses or stalls signing the release and causes a loss of sale, can we sue for slander of title?
