Can a lien be placed to collect inspection fee?


What is the name of your state? Ohio

Can a lien be placed on my propoerty for someone who is trying to collect a refund on an inspection they had on our house?

Here is the background story. We found a larger home we were interested and put a contract on it contingent to our getting financing. When we did this, we put our house on the market and a lady, who had filed for divorce from her husband, put a contract on our home contingent upon our financing. Naturally, they insisted on an inspection.

Our financing fell through, so both deals were off. This was 2003. Today the estrangled husband remarried the lady, and comes knocking at my door looking to collect the inspection fee or he will file a lien.

To the best of my knowledge, he cannot file a lien, personally because...
- he was not married to woman at that time, and she hired the inspector and paid him directly, it would be her obligation...
- however, I don't think she can because she needs some contract or judgement that says she paid us money for the inspection, or that we contractual owe her..

Please show me where I am wrong or right! Thanks.

I'd have to look at the sales contract, but I don't see you liable for their cost of inspection in this instance.

As to filing the lien, I don't believe there is any basis for that. You might remind the other party that you will sue him for damages if he files a lien without a legal basis.
