My grandfather donated land for use as a community cemetery in 1944(MS), but wished to reserve one row for his family (though this was not put in writing on the deed). My parents, grandparents, & uncle are so buried there, and the community has kept this row for my family for 57 years. Now, a group of people have set themselves up as a "cemetery association" to establish a perpetual care maintenance & upkeep of the cemetery, which is good. BUT - they claim to be legally able to impose maintenance fees for all plots (occupied or not) to the familey members, and the rules they have set forth stipulate that if these fees are not paid on a yearly basis, we forfit rights to be buried there. That's my family plot! Can they deny me & my grandfather's other heirs the right to be buried beside my family based on payment of fees they "invented"? (Until now, upkeep has been provided on a volunteer basis.)They are not an incorporated "legal enitity", but are seeking to become so - to which end, they want all of my family to sign a "quit claim deed" to the land grandfather donated.
