condemning residential property


South Carolina, North Myrtle Beach. My home is in the county, can the city condemn my property to build an Aquatic center while I am still in the county, or do they have to annex me into the city and can I stop the annex? - Thank you.

If the city has 'eminent domain' over the area enclosing your property, then they can exercise that right. If you are truly NOT in the city limits, nor in the jurisdictional limits, then they should not be able to exercise the rights of domain.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

I also would like to know should the city want to annex me from the county to the city limits, do I have a choice in the matter of being annexed or can they annex me without my approval? - Thank you. The process of annexing an unincorporated area can be pretty simple... and depends largely on whether the annexing agency (city) can recover more revenue from that annexation then liability it would assume. For this reason, you often find cities or towns annexing new shopping centers, communities with low debt, etc.

Reluctantly, once a city gets you into its sites, it is pretty hard (if not downright impossible) to get away.

annexation


South Carolina, North Myrtle Beach. Again thank you for your prompt reply. You stated that annexing an "unincorporated area" can be simple. There are approximately 10 acres of county property adjacent to the city property. Only a couple of acres of this is residential homes, the remaining being business. Should all the property owner’s wish to stay in the county, will we have an option or can the city annex us against our will. The primary reason the city wants this property is for parking only.

Ya'll can certainly try to lobby the city to not incorporate you, or for some kind of concessions, but it is highly unlikely that you will be able to steer the city away. As I said, once they set their sites on you, the 'options' are very limited.
Oh, and the ONLY options are political.

Do you have a Township Board ? If so what do they have to say ? Also have you been in contact with your county commisioners ?

annexation


No we do not have a township board. Upon speaking with a representative with the Governor's office, he also advised me to contact our commissioner. I have not yet been able to speak with him. That is why I decided to go this route. I'll try again to contact the commissioner. Thanks for the advise.
