What is the name of your state? Michigan

One of our condo association members wants to add a rule that bans smoking within our individual units since our building is old. Is this legal?

Cam dont you think it would be hard to control things that people do in the units they own ? Even if your board decided to do this how do they plan on enforcing it with units that do not have that written as a restriction ? your board might be able to create a non smoking rule and begin to enforce it as units are sold BUT if Jane and John Doe bought there unit recently and both smoke and both lived there for another 20 yrs and never stopped smoking does the board really think they could make them stop ? Also what about the guest of unit owners who while visiting are not barred from smoking by the units owner because the units owner isnt bothered by it . If it was a rental apartment building a non smoking rule would be easier and faster to implement . Very last thing has your board consulted with a attorney with this matter ?
