I am refinancing and the mortgage company is running into a problem. We have a townhouse with 2 units. There is no association fees or board members to make decisions. We take care of all maintenance ourselves and only consult with our attached neighbor if the house need to be painted, driveway need to be done, etc (anything that is shared). We told the mortgage company this and explained we have a condex. They put the house down as PUD. However, we have a master deed which states our townhouse as a condo association. Are we living in a condo or condex? If the deed is incorrectly stated, what can be done to rectify the document?

The lawyer for the mortgage company wants the 6D Certificate to be signed. As explained before, there are no trustees or association. Does the 6D Certificate need to be signed? If so, who should sign it since there are no Trustees?
