Question

covenants of subdivision


What is the name of your state? south carolina
3 years ago we bought a house in a subdivision. At the time of closing we were never told of any covenants or home owners association or its fees. Recently i constructed an electric fence to the side of my house and have two goats to eat the kudzue problem we are having. My neighbors then come over and inform me that we can't do that because it is restricted in the covenants. Should I have not been told of the covenants at the time of closing? The also state their is a regime fee in the subdivison. They said a lot of the houses are not paying it but at some point they will have too. In the 3 years I have been there I knew nothing of a homeowners ass. nore did I sign anything at closing. Am I liable for these dues?

**A: what are regime fees? Is this HOA maintenance/reserve dues? And you may be correct as there really is a homeowners ass.

in the convenants it stats no livestock animals. And that no fence shall be erected in the front of the house.
the homeowner ass. dues are for the lights and the upkeep of the sign coming into the subdivision. Am I in the wrong? I was under the impression i owned this property. Why was nothing signed on at closing?

what are cc&r's. my title sts all covenants and restrictions pertaining to the property apply.

Yup, THAT is what those documents, referenced in the title report you got at, or prior to, closing are telling you! That the restrictions listed in the title report apply to YOUR property. You bought SUBJECT to the existing restrictions. That is part of what the purpose of the title report is- to disclose the title issues that effect the property you are buying.
