When my wife and I applied to refinance our mortgage in September, we had a fica score of 640. Then a couple of days later our cridit was pulled again showing a false 30day late payment for July, bringing our score down so much that we couldn't refinance. We contacted the mortgage company and had to show them the canceled check proving that it had cleared on the 29th of June. They replied with an appoligy letter to us and the credit reporting agencies asking that it be removed from our records. This took about 45 days to clear from our records. When it did our credit came back up but not as much. So we try again and again there's another false 30day late this time for September. Again this is taken care of and score droppes again (more time wasted). To make a long story short, we have gone through this 5 times, today finding out that they "ACCIDENTLY" misplaced it again. And again our score dropps, this time down to 550. Our lender is preventing us from refinancing with a different lender. 5 times is no accident and we are told that they can continue to do this as long as they continue to fix it. So we will never refinance . Is their any corse of action we can take?

Yes, you can sue them.

Start off by talking to a few attorneys that specialize in litigating against lenders.
