Deed Recording - Marital Status


What is the name of your state? PA (Delaware County)

The deed for our property was recorded without any mention of our marital status. We are married and the deed identifies the Grantees as just John Doe and Jane Doe, instead of John Doe and Jane Doe, Husband and Wife.

I believe that it is important that our marital status is recorded correctly on the deed and I want to have the deed rerecorded.

Am I correct that this omission is indeed important and how do I explain this to the Land Transfer Company. The Land Transfer Company was previously advised of this problem along with an error in the recorded names. They had the deed re-recorded but only corrected the error with the name spelling and did not add the marital status as I had requested.

IN many states, there is a legal PRESUMPTION of Jt Tenancy when held between H&W, unless specifically stated otherwise. Check with the title company to see if this is the case there.

**A: did you buy the property or was it a transfer from a friend or relative? In any case, there should have been instructions to the title as to the tenancy.
