when my dad died, he left acreage and a house to his 5 kids. we now have a trustees deed to the property in oklahoma. we have had a survey done to divide the property. this was done with the approval of all 5 kids. problem-the property was left to us in percentages instead of acreage. 4 of us want the property divided so that we can build, etc. 1 wants the land to stay as it always was forever. now she is coming up with unreasonable reasons not to sign the new deeds, which she agreed to having drawn up. do we have any other option but to take it to court and force a sale? we don't want to lose the land, but we can't leave it like it is. the one who disagrees is manic-depressive, and it has gotten worse since the death of my parents. is it possible to have her declared mentally incompetent in this matter? we are desperate and if this is at all possible, we will see an atty. immediately. thanks
