Disclosure


I purchased a home last month in California and was told I was not in a flood zone. There were no disclosures made to me by seller that there was any tendency for flooding or water accumulation related to heavy rains etc. Two weeks after escrow closed a huge rainstorm resulted in local flooding. Many residents within a one block range were evacuated and neighbors went to shelters etc. Many of my yet unpacked belongings were in the garage which accumulated up to 6 inches of standing water. The water didn't remain long, but long enough to ruin many of my things including furniture, photos, clothing etc

If the seller, who had owned the property for about 2 years, had been told by previous seller, about potential flooding or water accumulation in garage, did he have obligation to disclose this to me? And if he did have that obligation and "forgot" to tell me, what recourse do I have?

I am not only concerned about property loss, but also that I may have bought a house that had more risks involved than I knew when I purchased it. (and how this will affect my eventual sale of the property)

**A: the answer is a resounding YES. sue his assets.
