we live in longview, tx. we purchased a home 10 years ago, it was an older home and we had no realitor. we were short 3500.00 for the down payment so the seller held back a 2nd mortgage. we paid 1145.00 on this 2nd mortgage, however we were told this was an older home and there would be problems, but that everything was in good working order. the first day we were there we started having problems, starting with the dishwasher, then the fence, gutters, shower, plumbing, heating/ac unit on and on, we documented everything. 15 months later, we quit paying on the second. we told them then that we were not paying anymore unless they fixed some of the problems, they refused and said that there was nothing wrong with the home, we took pictures of everything and documented conversations and problems. now we are trying to refinance and they will not sign off on the second saying we paid them only 297.00 and that we now owe a lot of interest. how do we go about settling this problem and where do we start? we want this signed off or some money back that we paid them, i happen to have copies of all the checks and money to prove how much we paid them in 1991 and 1992. what can we do?

First mistake: you did not use the services of a Realtor or real estate attorney.
Second mistake: you did not get a home nspection.
Third mistake: you waited too long and did not file a Court complaint therefore the time period has elapsed.

I suggest hiring an attorney to negotiate a fair settlement with the Seller.
