Do I Need A Lawyer?


What is the name of your state? TX, DALLAS.

Hello, My parents have decided to tranfer the house into my name. Will I need to hire a real estate lawyer to handle all of this or could we do it without one?

My parents own the house, no loans or anything both will be separating.

And also would all this be in like The City of Dallas, in the Courthouse? Where you can get house titles and everything? Would they hangle this aswell? Would I need a Special Warranty Deed? And also the original house title is lost but my mom and dad own the house. Would we hire someone to find a copy of the house title?

If you're comfortable in buying a house your parents might have put liens against which will never ever go away, and could haunt you 30 years from now when you try to sell the place? No, you don't need a lawyer.

What you could do if you're dead set on not using a lawyer is find Quit Claim Deed. Go to the Courthouse, and have it recorded. Since it's a parent/child transaction, there's not likely to be transfer tax, so all you should have to pay is the recording fees.

As for the lost "title" (in PA it is called a "deed") shouldn't be a problem unless it was never recorded. If it was recorded, you won't need to access it since you'll be replacing it any way.

Best bet? At least TALK to a lawyer.
