In West Virginia. When we bought our land we did not get the mineral rights. Now they are leasing them, I'm aware they can do that. But since we have purchased the land we now raise horses and use our land. This concerns me with our horses. What right as the landowners do we have with this. What if they tear the land up or do something we do not like who is responsable for fixing it, the drilling Co. that has leased or the people who own the mineral rights or both?? There is no talking to the people who own these mineral rights as far as asking them not to lease but I would like to know my rights as the land owner and if they can be held responsable for damages if any. Thank You.

You need to have an attorney review your title report to see exactly what rights were excluded.

Actually I can't find anything on all the papers we have about not getting the mineral rights. I'm going to the bank to see what papers they may have. If there is nothing on them about mineral rights what then do you think??? RC

Go to a real estate attorney and have him/her order a title report and give you a legal opinion.
