Domestic Use (water rights)


What is the name of your state? Az.

I own 10.5 acres of land with a well. I was approached by a person (developer?) who wishes to buy ajoining acreage and asked if I would sell him my water rights. Apparently, I have a total of 5 water rights, of which I could sell 4 and still keep 1 for my own use. I was informed of this fact (that i have 5 rights in total) by a local real-estate agent. My problem is where do i get verication that this is indeed true, and can i legally sell these rights? I have contacted the Az. Department of water resources to get general info, as well as title companies, but yet no one seems to know the answer. Can I legally sell these water rights? How? And how would i go about finding out the dollar value of these water rights?

You may love this site and are "thirsting" an answer, but I doubt anyone here can give you anything specific. You need to talk to a local real estate attorney with knowledge of this type of thing and you need an appraisal of the value of the water rights too. The big question is does the developer have other avenues for water rights.

It depends on what kind of water rights you have. Some are attached to the property and are not transferrable. This might help to explain some of your issues.
