Drainage Easement


What is the name of your state? Georgia

We had a new home built last July. When we put a deposit on the home and signed a contract with the builder, the drainage easement that was on our property was supposed to be only on the back 10 feet of the lot. When we came for the closing the drainage easement had moved up 15 extra feet. Our surveyed property states that the easement is only on the back 10 feet. I'm a little confused about how to fix the problem. Plus, we're really upset about the builder misrepresenting the lot that we had the home built on. The whole time we were building no one said anything. Is it too late to do anything about it now that we've already closed on the house?

Not really. We're upset about the whole thing. We're only going to be in the home for a couple of years. I suppose that we'll have to fix it before anyone else will buy it. It looks atrocious.

My response:

Why would you be upset? You're the one who closed on a piece of property with an open sewer pit in your yard. And, since you did, what makes you think that someone else wouldn't mind watching crap float through the yard too?

Why the hell would you sign when this existed? Is it because you're a Georgia Dufus?

Well, I'm not admitting to the "dufus" part, but we didn't know a lot about what our rights were, plus the contractor told us that they would fix it. I had just had a baby a month prior to closing and we were homeless at the time. We were desparate to be in a home. It really wasn't the greatest of situations.

What would make you think that everyone in the south lives in a trailer? Plus, doesn't it matter at all that the contractor told us that they would fix the situation?
