Drive way on neighbor's property

When we purchased 3 years ago our drive way is about 3 feet on the neighbor's property. The county has an easement right of this area. Our neighbor sold and our new neighbor is saying he is putting a fence on the property line that runs along the drive way. If the fence is placed on the line we will not have access to our garage or back yard by car.

Do we have any rights?

My response: check with the County on their easement. Generally, the County does not allow anything to be built on easements.

I was told by the County that if he put a fence up they would not be responsible for putting it back. The previous owners had some sort of agreement. Now what?
